Algemene voorwaarden Winterkamp

Winterkamp is een evenement van De Zwaardkring. Daarom gelden de veiligheids- en gedragsregels zoals deze ook binnen de Zwaardkring gelden;

Artikel 1. Aansprakelijkheid

  • Uitingen discriminerend, beledigend, intimiderend of kwetsend zijn;
  • Uitingen leiden tot onveilige situaties, uitsluiting of verstoring van de sportieve en respectvolle sfeer;

  • uitingen met een discriminerende, racistische, seksistische, homofobe of haatdragende boodschap;
  • politieke, ideologische of activistische uitingen die de sportieve neutraliteit en veiligheid van de vereniging kunnen ondermijnen;

Artikel 4. Calamiteiten

Ontruiming en calamiteiten

4.1 Brand of andere calamiteit

  • gaat een persoon uit de organisatie mee;

  • Discrimination, racism, bullying, or exclusion are strictly prohibited. Training partners and opponents must be treated in a sportsmanlike manner, including outside of training sessions and competitions.
  • Compliance with rules: Members must comply with the statutes, regulations, and instructions of the organisation and the HEMA-Bond. Everyone is expected to act with integrity and honesty: no cheating, no match-fixing, and under no circumstances the use of doping or prohibited substances. Instructors must not unnecessarily intrude into the private lives of athletes and must refrain from any form of abuse of power or sexual abuse.

  • Integrity and responsibility: The board, organisation, and instructors act transparently and in the best interests of the members and the organisation. Preventing conflicts of interest, corruption, and unethical behaviour is essential.
  • Alcohol: The use of weapons is not permitted after consuming alcohol or other intoxicating substances. If a participant is found to be in violation of this rule, they may be removed from the event.
  • Unsafe situations: If you encounter an unsafe situation (physical or social) or have any concerns, please contact the organisation. An independent confidential contact person will also be available, whom you may contact if desired. This person will be introduced at the start of the event.

Article 3a. Freedom of expression and forms of expression

The association recognizes and respects the right to freedom of expression of all members, instructors, board members, and volunteers. Within De Zwaardkring, individuals are free to express their personal views, opinions, and beliefs, provided that such expressions do not conflict with the values, standards of conduct, or objectives of the association.

Freedom of expression within the association is subject to the following limitations:

  • Expressions are discriminatory, insulting, intimidating, or hurtful;
  • Expressions lead to unsafe situations, exclusion, or disruption of the sporting and respectful atmosphere;
  • Expressions conflict with the law, this code of conduct, or the guidelines of the HEMA-Bond.

Article 3b. Appearance, patches and stickers

The wearing or display of patches, emblems, stickers, text, or symbols on clothing, protective equipment, bags, or weapons that may be perceived as offensive, polarising, or discriminatory is not permitted within the association.

This includes, but is not limited to:

  • expressions conveying a discriminatory, racist, sexist, homophobic, or hateful message;
  • political, ideological, or activist expressions that may undermine the sporting neutrality and safety of the association;
  • symbols or text that conflict with the law or generally accepted social standards.

The organisation is entitled to ask a member to remove or cover up such expressions during the event. If the member fails to comply, participation may be refused.

This provision is not intended to prohibit personal expression, but to ensure a safe, inclusive, and respectful environment for all participants.

  • An instructor, volunteer, or member of the organisation will guide the emergency services to the appropriate location and, where necessary, provide information about the situation.

References and legislation

This code of conduct is aligned with relevant legislation, regulations, and guidelines applicable to sport. For example, the requirements of the Wet Algemene Bepalingen inzake Sport (WABS) and the Wet op het Olympisch en Amateuroptreden in Sport (WOAS) apply indirectly through NOC*NSF regulations. The code also takes into account the Constitution of the Netherlands (Article 1) and the prohibition of discrimination, the General Data Protection Regulation (GDPR) concerning privacy, and the former Wet bescherming persoonsgegevens (Personal Data Protection Act). For minors, the Jeugdwet (Youth Act) applies in relation to the right to confidential consultation. The HEMA-Bond may apply its own disciplinary regulations or anti-doping rules, which are applicable in this context.

In addition, De Zwaardkring endorses the NOC*NSF recommendations for a safe sporting environment. These include, among other things, the requirement for each sports federation to establish a code of conduct, which clubs are required to adopt, and for incidents of inappropriate behaviour to be reported through the national reporting centres. Within the foundation, confidential advisers are available, and preventive measures, such as awareness and information sessions, are being developed to promote a safe and inclusive environment.
